Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Kerala High Court judgment.
The judgment of the Kerala High Court records the following account. A Kollam man, picked up from Sanker's Hospital, Kollam, on 6 April 2005 on suspicion of mobile-phone theft, was informally detained without recording arrest and tortured by two crime-squad constables of Kollam East Police Station at the Sardar Vallabhbhai Patel police museum lock-up to extract a confession; he died the same evening and the death was homicidal. The trial court convicted both constables of custodial murder under Sections 302 and 348 read with Section 34 IPC. A Division Bench of the Kerala High Court held the deceased was in the exclusive custody of the two accused and, finding no intent to kill, altered the murder conviction to culpable homicide not amounting to murder with five years rigorous imprisonment each, confirmed the wrongful-confinement conviction and sentences to run concurrently, and left the Rs 2,00,000 compensation to the victim's mother undisturbed.
