CW-2021-0007North West Delhi, DelhiJudgment 15 September 2021

Delhi Police Assistant Sub-Inspector vs C.B.I.

The Delhi High Court dismissed ASI 's appeal and sustained his CBI-trap conviction, withdrawing bail granted in 2001 and ordering him taken into custody forthwith. The court found that while investigating a kidnapping complaint against a Keshav Puram man, he demanded Rs 10,000 reduced to Rs 5,000 on 15 June 1996 threatening arrest even though the couple had married with family consent; he accepted the tainted notes, then assaulted CBI officers, smashed the hand-wash glass and fled to the police-post roof before recapture. The court held demand, acceptance and recovery proved by the shadow witness and trap party despite minor variations. The concurrent sentences under the PC Act and IPC provisions, with a maximum of 3 years simple imprisonment, were sustained. Matters not addressed in the cited judgment text are not recorded here.
