ConcludedThe Orissa High Court recorded adverse findings against police personnel and ordered Rs 30,000.
The judgment of the Orissa High Court records the following account. A Jeypore man @ Abhijit Mohuria was illegally detained at Jeypore Town police station from 29 October to 2 November 2016. After the SP Koraput's report drew a blank, the OHRC's own investigation wing established the detention and recommended (7 September 2021) registration of a regular criminal case, Rs.30,000 State compensation, and recovery from the Inspector In-Charge and Sub-Inspector equally. The officers' writ challenge failed before a Single Judge (29 October 2021). A Division Bench of Chief Justice S. Muralidhar and Justice A.K. Mohapatra dismissed their writ appeal, holding victims of police excess cannot be expected to produce records controlled by the police themselves, and calling the compensation amount insubstantial.
