Order issued
ConcludedThe Allahabad High Court recorded adverse findings against police personnel and ordered Rs 50,000.
The judgment of the Allahabad High Court records the following account. Police arrested the two petitioners under Section 151 Cr.P.C. on 8 October 2020 over an ancestral land dispute, and a Sub-Inspector of Rohania police station sent a printed-form challani report under Sections 151/107/116 Cr.P.C. with only names and the words 'land dispute' filled in. The SDM registered the case without recording satisfaction or issuing a show-cause order and kept the petitioners detained from 12 to 21 October 2020 even after they submitted personal bonds. The Division Bench held the police authorities were arbitrarily and illegally submitting such challani reports and that the SDM acted in clear breach of Sections 107, 111 and 116 Cr.P.C. and Article 21. It recorded payment of Rs. 25,000 compensation to each petitioner under the State policy of 23 March 2021 and issued statewide compliance directions.
