ConcludedThe Delhi High Court upheld service punishment imposed on police personnel.
The judgment of the Delhi High Court records the following account. Head Constable and ASI of Delhi Police were on passport-checking duty at Terminal 2, IGI Airport, on the night of 23/24 March 1996 when a surprise check by the DCP led to the recovery of 75 Dirhams from Kumar's pocket. The court noted that questioned passengers confirmed police officials at the gate were extorting and taking money, and a joint departmental enquiry resulted in both officers being dismissed from service on 20 September 1999. The court held that recovery of foreign currency from a non-traveller policeman plus witness statements clearly established corrupt misconduct, rejecting the plea that it was a case of no evidence. Finding no procedural irregularity or violation of natural justice, the Division Bench upheld the dismissal orders of the Disciplinary Authority, the Commissioner of Police (appellate order, 2002) and the CAT, and dismissed the writ petition. Matters not addressed in the cited judgment text are not recorded here.
