ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 1,000,000.
The Bombay High Court (Aurangabad Bench) held that businessman [name withheld], in his early forties and in MIDC (Latur) police custody on remand till 16-10-2017, died after the lock-up guard negligently handed phenyl directly to him in the lock-up on 15-10-2017, which he consumed and for which he died during treatment. The court found the police machinery indirectly responsible for a death in its custody and liable to compensate as an instrumentality of the Government. It declined CBI transfer since the CID/DySP probe was continuing, and rejected the Rs 2 crore claim. It awarded Rs 10 lakh compensation to the widow and minor son (Rs 2.5 lakh each in fixed deposit, Rs 5 lakh to the widow within three months), holding the brother and mother not entitled.
