ConcludedThe Calcutta High Court recorded adverse findings against police personnel and ordered Rs 500,000.
The judgment of the Calcutta High Court records the following account. At midnight on 3 September 2003, 35-year-old scrap dealer a G.T. Road between Shrirampur and Belur man was shot dead by Constable on G.T. Road for riding past a vehicle check; the constable was separately convicted of murder and sentenced to life imprisonment. An Executive Magistrate inquiry under the Police Regulations of Bengal found the firing wholly unjustified, brutal and excessive, but no follow-up action was taken. The Single Bench awarded Rs 3,00,000 in 2015 (paid only in 2016); the Division Bench held the Article 21 violation indisputably established and directed an additional Rs 5,00,000 (Rs 8,00,000 total) within 60 days, noting thirteen years of delay. Compensation recorded here is the Rs 5,00,000 ordered by this judgment. Matters not addressed in the cited judgment text are not recorded here.
