CW-2022-0028Vadodara, GujaratJudgment 14 March 2022

Vadodara City Police Police Constable vs The Commissioner of Police & Ors.

On 14 March 2022 the Gujarat High Court dismissed the writ petition of a Vadodara City police constable and left his dismissal from service undisturbed. The court recorded that the petitioner, suspended in March 1990 and charge-sheeted in 1994 for stealing motorcycles with duplicate keys and reselling them with duplicate number plates, had been acquitted in the parallel criminal cases under section 379 IPC but found guilty in a detailed departmental inquiry, leading to dismissal in November 2003, confirmed in appeal and revision. The court held that an acquittal premised on similar facts cannot ipso facto dilute a punishment order and that judicial review cannot re-appreciate evidence as an appellate authority. Matters not addressed in the cited judgment text are not recorded here.
