Kudimangalam Man v. Secretary to Government of Tamil Nadu and Others

The judgment of the Madras High Court records the following account. A Kudimangalam man met with a road accident on 31.10.2014 within Kudimangalam Police Station limits, was admitted to Coimbatore Government Medical College Hospital, and died unidentified on 13.11.2014 without any FIR being registered, despite the accident having been intimated to the station and family visits with a missing-person notice. On 20.07.2022 the Madras High Court held the Kudimangalam police personnel and hospital staff had failed their public duty and constitutional mandate, violating the deceased's fundamental right to competent medical treatment and letting him die as an orphan. The Court awarded Rs.15,00,000 compensation at 6% interest, recoverable from the responsible police officials and medical staff, and ordered the SP, Tiruppur to have the accident reinvestigated by an officer not below DSP rank with a supplementary final report within three months. Matters not addressed in the cited judgment text are not recorded here.
