Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Allahabad High Court judgment.
The Allahabad High Court (Division Bench, 22 December 2022) partly allowed Criminal Appeal No. 4666 of 2014 but sustained the guilt of U.P. Police Constable of Police Station Chikasi, Hamirpur, who on 2 January 2008 abused and beat fellow constable with a rifle butt at the station gate and then fired his government rifle at the constable's mother [name withheld] when she intervened; she died of the gunshot injury after giving a dying declaration. The Court held the killing was homicidal but unpremeditated, a single shot in the spur of the moment, converting the trial court's Section 302 IPC life sentence (Sessions Trial No. 9 of 2009, decided 27 November 2014) to Section 304 Part I IPC. The appellant was sentenced to the period already undergone (10 years 7 months with remission) with a fine of Rs.5,000 (three months' simple imprisonment in default).
