The Bombay High Court (Aurangabad Bench) held there was total negligence by the Beed jail authorities and the on-duty police guard in denying medical care to 32-year-old undertrial a Beed man, who complained of chest pain from early February 2012 but was shifted to hospital only on 23-02-2012 and died on 27-02-2012. The court found the police guard declined to shift him to Government Medical College, Aurangabad despite medical advice, violating his Article 21 right to health. Rejecting the State's denial of negligence, it awarded Rs 10 lakh compensation to the parents, widow and two minor children, payable within four weeks (6% interest on default), with liberty to recover from the negligent officers.
