Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Madras High Court judgment.
The Madurai Bench of the Madras High Court dismissed a criminal revision case filed by police officer Kannan and affirmed his conviction under Section 330 IPC for inflicting custodial torture to extort a confession. In December 2005, the victim was brought to Nainarkovil Police Station on suspicion of jewel theft, where the petitioner tied his hands and legs, beat him with a lathi, and kicked him with boots, causing injuries that required hospitalisation at Paramakudi Government Hospital and Madurai Rajaji Hospital. Rejecting the officer's plea that sanction under Section 197 CrPC was required, Justice G.K. Ilanthiraiyan held that custodial violence forms no part of official duty and was conclusively established by the medical evidence and the RDO enquiry. The Court affirmed the modified sentence of six months simple imprisonment and a fine of Rs 20,000, of which Rs 10,000 was awarded to the victim as compensation.
