ConcludedThe Allahabad High Court entered convictions against police personnel in this judgment.
The judgment of the Allahabad High Court records the following account. Head Constable Mukesh Kumar of Maharajpur Outpost under Link Road Police Station in Ghaziabad demanded monthly extortion bribes of Rs 500 from each three-wheeler tempo owner operating between Maharajpur and Sahibabad Mandi under threat of stopping their vehicles. Complainant [name withheld] approached the Vigilance Department at Meerut, and following an inquiry, an anti-corruption trap was executed on 7 September 2000. The respondent was caught red-handed inside his room at the outpost accepting Rs 7,000 in tainted currency collected from fourteen vehicle owners along with a written list, and chemical tests on his hands and pocket yielded positive results. Although the Special Judge (Anti-Corruption), Meerut, acquitted the respondent in May 2003 on unfounded allegations of enmity, the Allahabad High Court reversed the acquittal, found the demand, acceptance, and recovery conclusively established, and convicted him under Sections 7 and 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988, sentencing him to one year of rigorous imprisonment and a fine of Rs 3,000.
