ConcludedThe Delhi High Court recorded adverse findings against police personnel and ordered Rs 100,000.
After a 2-year-old's death in February 2014, Delhi Police (FIR 103/2014, PS Mansarovar Park) charged the paternal grandmother a Delhi woman and father [name withheld] with murder and cruelty; the trial court acquitted them of murder but convicted them under s.23 of the JJ Act 2000 (6 months, already undergone), which they were too poor to appeal. The Delhi High Court disposed of the State's appeal against the murder acquittal, holding the investigation terrible and unfair: a fall was never excluded, the rod/stick recovery was not exclusive knowledge, the father was at work, and the child's 5 kg weight showed chronic neglect rather than the alleged starvation. It set aside the JJ Act conviction in the interest of justice, awarded Rs.50,000 each at the cost of the prosecution, and cautioned prosecution agencies against casual appeals.
