CW-2023-0044Medchal-Malkajgiri, TelanganaJudgment 30 June 2023

Bachupally Resident & Ors. v. State of Telangana

The Telangana High Court allowed a Section 482 petition and quashed the proceedings against four accused in a Bachupally land-trespass case (C.C. No. 33 of 2019). The Court found the charge sheet was filed without any basis: the petitioners were named neither in the FIR nor the private complaint nor by any witness, while the person actually named by the complainant was deleted without reasons. Holding this a clear case of abuse of process causing needless prosecution and mental agony through improper investigation, the Court awarded Rs 25,000 exemplary costs payable by the State with liberty to recover the sum from the investigating officer who filed the charge sheet. Matters not addressed in the cited judgment text are not recorded here.
