CW-2023-0051Kolkata, West BengalJudgment 6 September 2023

The State of West Bengal & Ors. vs. Calcutta Police Constable

Constable of Calcutta Police was booked for Central Bank guard duty with firearms on 23 July 2000, left without informing any authority and without depositing his firearm, and remained absent until 8 August 2000, during which he was arrested on 31 July 2000 in an English Bazar impersonation case and held in custody until 7 August 2000. The disciplinary authority dismissed him on 22 September 2003, but the West Bengal Administrative Tribunal set aside the dismissal and directed reinstatement. The court held the charges stood established by the respondent's own admission, that abandoning guard duty and issued arms was serious dereliction unbecoming of police personnel, and that the enquiry complied with natural justice. It held the Tribunal exceeded jurisdiction in interfering with the quantum of punishment, set aside the Tribunal order, and restored the dismissal. Matters not addressed in the cited judgment text are not recorded here.
