CW-2024-0010Latehar, JharkhandJudgment 22 June 2024

Garu Man vs State of Jharkhand and Ors.

A Garu man was forcibly taken from his home in 2022 by Garu police led by SI, confined at the police station for three days and mercilessly assaulted with lathis to coerce an admission of helping naxals, then released when police realised he was the wrong person — facts the Court recorded as admitted by the State. The police had submitted a chargesheet against the SI and other officials, and the State had sanctioned only Rs 50,000 as compensation. The High Court held that Rs 50,000 was inadequate for such arbitrary torture of a citizen against whom there was no material, enhanced compensation to Rs 5,00,000 payable by the State within two weeks, and directed recovery of the amount from the torturing officials within two months. Matters not addressed in the cited judgment text are not recorded here.
