Syed Allauddin Baber vs The State of A.P. rep. by its Spl. P.P. Hyd., for ACB

The Telangana High Court upheld the conviction of Head Constable Syed Allauddin Baber of the MGBS police outpost for demanding and accepting a Rs 500 bribe from an ex-Air Force man turned bank clerk. The Court found the officer had stopped the complainant at the bus station on 23 December 2003 on a false solicitation pretext, seized his driving licence and CAT card, and insisted on Rs 500 for their return. The ACB trapped him on 8 January 2004 when he took the tainted notes and his right-hand wash tested positive. It held demand and acceptance proved by the complainant, the mediator and the seized documents found in his possession, dismissed the appeal, and directed him to surrender to serve the remaining sentence with Section 428 set-off.
