Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Jammu and Kashmir and Ladakh High Court judgment.
The judgment of the Jammu and Kashmir and Ladakh High Court records the following account. Constable of District Udhampur police absented without authorisation from 29 September to 11 November 2001; on rejoining, police seized militants' photographs and film negatives from him, and investigation established he was harbouring Mahore-area militants to spread militancy, culminating in a confessional statement before the SSP Poonch under s.32 POTA. The POTA Designated Court (Jammu) convicted him under s.3(4) POTA in July 2010 with 3 years imprisonment plus Rs.1,000 fine. A Division Bench of Justices Sanjeev Kumar and Puneet Gupta dismissed his appeal, holding a s.32 POTA confession must be of sterling value and corroborated as a matter of prudence, upheld the conviction and sentence, cancelled his bail bonds, and ordered surrender within ten days.
