New Delhi Man v. Govt. of NCT of Delhi and Others

The Delhi High Court (Justice Subramonium Prasad) directed Delhi Police to pay Rs 50,000 to vegetable vendor a New Delhi man, who was picked up on a knife-attack complaint (DD No.85A) on 2 September 2022 and kept in the PS Badarpur lockup from 11:01 to 11:24 p.m. without any formal arrest, FIR or DD entry. Liability had been found in the 5 October 2023 judgment; the 12 March 2024 order holds that even half an hour's detention without due procedure violates liberty, that a mere censure is no deterrent, and orders a proper inquiry to fix responsibility and recover the sum from the officer concerned. Both SIs had been censured departmentally; respondent 4's appeal against the DCP's censure order was pending.
