Satara Man vs The State of Maharashtra and Others

The Bombay High Court (A.S. Chandurkar, J.; Rajesh S. Patil, J. concurring) held that Police Inspector (ex-SHO, President's Police Medal 2004) was arrested illegally on 13 March 2013 at 17:15 by Addl. SP Amol Tambe over alleged faulty investigation in Crime 19/2009 and kept about 20 hours till bail on 14 March 2013. No State consent under Section 45(2) CrPC was obtained though he was a police officer acting in official duty, arrest memo/grounds were not recorded, the station diary entry was made 6+ hours late, and arrest was for bailable offences (ss. 201/218/221 IPC) without recording reasons. Finding gross Article 21 violation, the Court awarded Rs. 2,00,000 compensation from the State within eight weeks (6% p.a. interest on default), with recovery from guilty officers permitted after due process. Matters not addressed in the cited judgment text are not recorded here.
