The Allahabad High Court, Lucknow Bench (Division Bench, 29-11-2024), convened at 6:30 p.m. on a habeas mentioning, found that investigating officer Sub-Inspector of Police Station Jagdishpura, Agra, took an eight-months-pregnant woman and her two-year-old child from home to Police Station Chinhat, Lucknow, at about 12:15 p.m. merely to record a section 161 statement in a 2021 kidnapping FIR and kept them there until the court intervened. The court found the FIR disclosed no cognizable offence, the officer acted without case diary and without checking age or marital status, and called the detention torture and a clear abuse of authority. It awarded Rs.1,00,000 exemplary cost against the State as compensation payable within ten days, restored the victim to her residence, and directed the Director General of Police to draw proceedings against the investigating officer within three months and report back on 11-12-2024.
