Order issued
ConcludedThe Supreme Court of India recorded adverse findings against police personnel and ordered Rs 5,000,000.
The Supreme Court allowed the appeals of J&K police constable, posted at District Police Headquarters Baramulla, who was illegally detained at the Joint Interrogation Centre, Kupwara from February 20 to 26, 2023 and subjected to custodial torture including amputation of his testicles, pepper sprinkled on his genitalia and electric shocks, leaving him comatose and surgically castrated. Holding the Article 21 violation evident and egregious as established through medical records, the Court quashed as mala fide and fabricated the counter-FIR No. 32 of 2023 under Section 309 IPC lodged against the victim to shield guilty officers. It directed the CBI to register an RC within 7 days, arrest responsible officials within one month, complete investigation in 90 days and probe systemic issues at JIC Kupwara, set aside the High Court order dated September 18, 2023, and ordered the Union Territory to pay Rs. 50,00,000 interim compensation recoverable from guilty officials.
