CW-2025-0013HaryanaJudgment 21 July 2025

Arshad v. State of Haryana & Ors.

The judgment of the Punjab and Haryana High Court records the following account. Haryana Police Constable Arshad, who joined in April 2012, proceeded on one week's leave on 12 January 2023 and never returned, remaining absent for over 300 days; his justification included treatment for black magic by a tantrik. Suspended in September 2023, he boycotted the enquiry, was found guilty ex parte, and was dismissed on 20 June 2024 after a record of 40-plus prior absences, with his appeal and revision failing. The Punjab and Haryana High Court held armed forces cannot retain an indisciplined member, declined to interfere on proportionality for a habitual offender, and dismissed the writ petition. Matters not addressed in the cited judgment text are not recorded here.
