Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Gujarat High Court judgment.
Police constable Mahendrasinh Balusinh Raol was found intoxicated while on point duty at Pirana Toll Naka, Ahmedabad, on 14 December 2003, with blood alcohol of 0.0945% w/v against the 0.05% limit. A Metropolitan Magistrate convicted him under Section 66(1)(b) of the Bombay Prohibition Act, 1949 (three months' simple imprisonment and Rs.500 fine) in February 2010, and the Sessions Court dismissed his appeal in 2011. The Gujarat High Court held the FSL chain and Blood Test Rules complied with and that the acquittal under Section 85(1)(3) did not affect the Section 66(1)(b) conviction. Dismissing the revision, the Court held on-duty intoxication by a policeman a grave misconduct, refused probation or sentence reduction, and ordered surrender within two weeks.
