ConcludedThe Kerala High Court recorded adverse findings against police personnel and ordered Rs 1,400,000.
The Kerala High Court held that an NRI rent-a-car worker home on 15 days' leave for his daughter's wedding was falsely implicated in Chakkarakkal Crime No. 388/2018, a chain-snatching case, arrested on 11 July 2018 and kept 54 days in custody despite CCTV identity mismatch and his impossibility plea. A DySP enquiry exonerated him and implicated the real accused [name withheld], noting lapses by the SHO and two ASIs and recommending transfer plus a Punishment Roll entry against SI. The court held the wrongful arrest and detention violated Article 21 and awarded Rs 10 lakh to the first petitioner and Rs 1 lakh each to his wife, two sons and daughter as public-law compensation under Article 226. The State was left at liberty to recover the amount from the erring officers, and the petitioners free to pursue civil remedies.
