CW-2025-0028HaryanaJudgment 4 December 2025

Haryana Police Constable vs State of Haryana and others

The Punjab and Haryana High Court dismissed Constable's writ petition and upheld his dismissal from service for inaction on prisoner-guard duty. Part of a three-man guard holding two undertrial prisoners in safe custody, he possessed a carbine but did not fire when assailants attacked, letting them escape after killing one undertrial and seriously injuring the other; the enquiry officer found him guilty of inaction and he was dismissed on 28 July 2003, with his departmental appeal and revision also failing. The Court held the enquiry procedurally sound with unassailable factual findings in writ jurisdiction, noting also the 22-year delay since dismissal. Matters not addressed in the cited judgment text are not recorded here.
