Chennai Man v. State (NDPS Case - Fabricated Documents)

The Madras High Court acquitted four accused in an NDPS case involving alleged possession of 54 kg of ganja at Egmore Railway Station. The Single Judge found multiple fabrications by the NIB-CID police: (1) all documents (secret information, search notice, seizure mahazar, arrest report, inspection memo) were typed, indicating preparation in the police station rather than at the scene; (2) joint search notice and joint consent were obtained from all four accused, violating Section 50(1) NDPS Act which requires individual communication of the right to be searched before a gazetted officer or magistrate; (3) the prosecution failed to produce the general diary or permission from a superior officer despite PW1's deposition; (4) there was an unexplained 9-day delay in producing the contraband before the trial court. The court held these discrepancies created suspicion that a false case was registered.
