CW-2026-0019Unnao, Uttar PradeshJudgment 29 April 2026

Asiwan Man (through his son Asiwan Man) vs State of U.P. & Ors.

The judgment of the Allahabad High Court records the following account. An Asiwan man was arrested on 27 January 2026 in Case Crime 244/2024 though the arrest memo cited only the case number without specific grounds, and was remanded on 28 January 2026. The court found the arrest violated Article 22(1) under Mihir Rajesh Shah and the remand based on it was also illegal, ordering forthwith release after 3+ months in custody. It imposed Rs 10 lakh exemplary costs on the State payable within 4 weeks, with liberty to recover from responsible officials. On 22 June 2026 the Supreme Court stayed payment of the compensation on the State's quantum-only appeal, when the State informed the court the SHO had been suspended.
