Kutta Man v. State of Karnataka and Another

The Karnataka High Court held that a Kodagu homestay owner's arrest by Kutta Police in April 2026, in a case over the alleged rape of a foreign guest, was illegal: the offences alleged against him personally were non-cognizable, he was not present when the alleged offence occurred, and the arrest did not comply with the safeguards in Arnesh Kumar and Sections 41/41A. He had been held for 13 days before bail. The High Court declined to quash the FIR but ordered the State to pay him Rs. 5,00,000 as compensation. On 22.09.2026 the Supreme Court dismissed the State of Karnataka's special leave petition against that order.
