Order issued
ConcludedThe Gauhati High Court recorded adverse findings against police personnel and ordered Rs 1,200,000.
The Gauhati High Court Division Bench held that Assam Police firing on protesters at Maibang railway station on 25 January 2018 violated the victims' fundamental rights, awarding Rs. 3 lakh each to the families of the two deceased and Rs. 2 lakh each to three seriously injured persons (Rs. 12 lakh total), payable within three months. The Court accepted that protesters had turned violent and pelted stones, but found police fired from the railway platform onto protesters on the tracks causing bullet injuries above the waist, showing lack of understanding of the situation. It held the doctrine of sovereign immunity does not apply to fundamental-rights violations and that the State, not individual personnel, would bear the exemplary public-law damages.
