CW-2026-0099North East, DelhiJudgment 25 September 2026

North East Man vs The State NCT of Delhi

The High Court recorded that a man arrested in an FIR at New Usmanpur police station was released by a Karkardooma magistrate on 23.07.2026 because the grounds of arrest supplied to him bore no date or time and gave no details of the incident, as the Supreme Court requires in Mihir Rajesh Shah. Police re-arrested him on 21.08.2026 after POCSO Act offences were added to the FIR, without first seeking the superior officer's endorsement and the court's permission that the Supreme Court prescribes for a re-arrest. The State's counsel, on instructions, accepted that this procedure was not followed. On 25.09.2026 a Division Bench held the re-arrest illegal and in violation of his fundamental rights, and ordered his immediate release on the original magistrate's terms, without expressing any view on the merits of the accusation.
