Order issued
ConcludedThe Madhya Pradesh High Court set aside the NSA detention order of 6.1.2026 against both brothers, finding non-application of mind caused by incorrect criminal-history data supplied by police.
Two brothers in Jabalpur were detained under the National Security Act by the District Magistrate's order of 6.1.2026, after a country-made bomb explosion on 4.1.2026 that police attributed to one of them; the detention was extended on 1.4.2026 and 6.7.2026. The High Court found that the City Superintendent of Police, Gohalpur, listed fourteen cases as pending trial when the petitioner had been acquitted in eleven of them, some as far back as 2004, and that the report went from the CSP to the Additional SP, the SP and the District Magistrate on the same day. It held that this incorrect supply of data, its mechanical forwarding and the District Magistrate's reliance on it without verification vitiated the detention, which could have been checked on CCTNS 'with the slightest of efforts'. The court also recorded that the SP had issued a show-cause notice to a sub-inspector over manipulation of CCTV footage of 4.1.2026. The detention orders were set aside on 11.09.2026.
