CW-2026-0105Deoria, Uttar PradeshJudgment 9 September 2026

Deoria Man And 3 Others vs State Of U.P. And 2 Others

The High Court recorded that after a murder FIR at P.S. Gauri Bazar, Deoria, police took relatives of a named accused, who were not themselves accused, into custody: a man was held for two days, and two women and a two-and-a-half-year-old girl were held from 13.04.2026 to 23.04.2026 without arrest or production before a Magistrate, and were released a day before the habeas corpus petition was filed. The SHO said the station's CCTV stopped working on 12.04.2026; the Superintendent of Police's own inquiry found him guilty of dereliction for not keeping it functional, and the DVR held only fragments of footage for 12-16 April. The court applied the presumption against the party withholding evidence, held the SHO responsible for the detentions, observed that footage may have been deliberately deleted, and directed the State to pay Rs 20,000 each to the three held for ten days and Rs 5,000 to the man, to be recovered from the salary of those responsible after an enquiry, with its displeasure recorded in the SHO's service book.
