State (V&AC Nagercoil, Crime No.2/1999) v. Chinnamoni (A1, SSI) & P. Paul Nadar (A2, HC) — Special Case No.3 of 2002

The Nagercoil CJM-cum-Special Judge on 5 December 2007 convicted SSI Chinnamoni (A1) and Head Constable P. Paul Nadar (A2) of Kanyakumari police station for detaining a motorcyclist on 4 October 1999 on a false illicit-liquor pretext, snatching Rs.370, extracting Rs.1,000 and demanding a further Rs.1,000 to release his motorcycle, for which a V&AC trap caught A2 receiving tainted money in the station verandah, sentencing each to 5 years RI with Rs.10,000 fine per count under PC Act ss.7 and 13(2) r/w 13(1)(e). The Madras High Court (Madurai Bench, Justice S. Palanivelu) on 30 July 2010 dismissed both appeals (Crl.A(MD)Nos.649-650 of 2007), holding the charges proved beyond reasonable doubt, but reduced the sentence to one year RI per count given the length of proceedings.
