ConcludedThe Punjab and Haryana High Court recorded adverse findings against police personnel and ordered Rs 40,000.
The Punjab and Haryana High Court dismissed the State's appeal and upheld the Rs 40,000 damages decree against the State and constable-driver [name withheld] in favour of lawyer a Rajpura man, a Save Hindi agitation volunteer arrested at Chandigarh station on 15 July 1957, detained at Chandimandar and then conveyed at night in police van PNE 4615. The court held the arrest without warrant, non-production before a Magistrate and conveyance for dispersal were without statutory authority and not a sovereign function. It found the exhausted driver, whose plea for relief was refused, dozed off near Rajpura and struck a tree, crushing the plaintiff's left arm — negligence, not an act of God. The suit against AIG A.[name withheld] was dismissed and nothing was awarded for the detention itself; all then in undivided Punjab. Matters not addressed in the cited judgment text are not recorded here.
