Qadian Man vs Senior Superintendent of Police, Batala and Another

The Punjab and Haryana High Court held a Qadian man, picked up without valid reason by Qadian police, was tortured with third-degree methods in ASI Gurmeet Singh's custody, fracturing both hip joints and permanently disabling him. The Court set aside the first Sessions enquiry, endorsed the supplementary report drawing an adverse inference against the ASI, and found the clean-chit medical board report of 30 December 1995 was procured by police pressure on doctors. It awarded Rs 1.5 lakh interim compensation against the State with recovery rights against defaulting officers. Torture by SHO was held not proved.
